Havens Quoted in Columbus Business First Story titled “Obamacare Comes with Part-Time Puzzle for Employers”

Jolie Havens, a partner in the Vorys Columbus office, was quoted in a Columbus Business First story about the decisions employers are facing as they move forward with the implementation of policies related to the Affordable Care Act (ACA).  The story focused on the section of the ACA that requires companies with 50 or more employees provide health insurance to those who work 30 hours or more a week or pay a penalty.  According to the story, this changes the definition of “part-time” work for many employers, including restaurants and retailers.

The story states:

“Internal Revenue Service rules have settled some questions, such as exemptions for temporary and seasonal employees, said Jolie Havens, partner in the Columbus health-care practice of Vorys Sater Seymour and Pease LLP. But companies no longer can get out of providing benefits by calling year-round workers ‘independent contractors.’

‘Who gets coverage and who doesn’t is going to be much more based on the math rather than whatever internal classification the company has,’ Havens said.”
