Vorys Attorneys Featured in Corporate Counsel Article Titled “Bad Online Reviews Can Be a Legal Matter”

Whitney Gibson and Jordan Cohen, attorneys in the Vorys internet defamation group, were featured in a Corporate Counsel article about false online reviews posted by competitors.  The article was titled "Bad Online Reviews Can Be a Legal Matter."

The article states:

“Though the senior litigation counsel for Yelp has been quoted as saying that fake reviews on the site are targets of law enforcement, Gibson and Cohen say there is very little to suggest that this is really the case. The false reviews are, however, a possible violation of state unfair competition laws or the federal Lanham Act—which allows businesses to potentially recover damages, corrective measures and attorneys fees upon proving the false review was willful, they say.

The first step for a company after receiving a false review online is to work to identify the poster if they’re anonymous. This typically is done through the subpoena process, explain Gibson and Cohen.”
