Inc. asked a California federal judge on Monday to throw out a proposed class action filed by an employee who claims she wasn't able to sit on the job, with the retailer alleging it was not obligated to provide seating. The retailer lodged a motion to dismiss a complaint brought by Amber Echavez, who accused Abercrombie of violating California law by not making the use of a seat available to her during her shifts as a sales employee and sought civil penalties for herself and other employees.”
