Anti-Password Legislation Could Have Mixed Results

Jackie Ford, a partner in the Vorys Houston and Columbus offices, authored an op-ed for the Houston Chronicle entitled “Anti-Password Legislation Could Have Mixed Results.” The op-ed is about a proposed Texas law (Texas Senate Bill 118) that would prohibit employers from asking employees and job seekers for passwords to their social media accounts. Ford says that employers rarely ask for applicants or employees' passwords and that the legislation is legally unnecessary. She notes that the federal Stored Communications Act, which prohibits various forms of electronic hacking, prohibits unauthorized accessing of a password-protected account.
